The negligence lawsuit against the restaurant chain did not specify monetary damages.
The suite was filed in state Supreme Court in Riverhead for Tyler Vormittag, 11.
Vormittag allegedly became ill after consuming three tacos with cheese and lettuce at the Taco Bell in Riverhead on Nov. 24, according to attorney Andrew Siben.
"When a restaurant serves food, it is deemed to be fit for human consumption and that it does not contain any deleterious or harmful substances," Siben said. "The Taco Bell restaurant clearly breached that duty."
Siben adds that the boy was hospitalized and treated with morphine.
A Taco Bell spokeswoman said the company had no immediate comment.
E. coli is short for Escherichia coli. It is a common and ordinarily harmless intestinal bacteria. The Center for Disease Control and Prevention reports that the strain of E. coli that caused the infections is often found in the intestines of healthy goats, sheep and cattle.
