The case was filed against the FDA, the Department of Health and Human Services and the Pentagon, was dismissed by the federal judge, Rosemary Collyer saying that the Food and Drug Administration found the vaccine to be safe and approved its used.
"The FDA applied its expertise and found the vaccine is effective," Collyer wrote. "The FDA did not act arbitrarily or capriciously. ... The court will not substitute its own judgment when the FDA made no clear error in judgment."
For 20 months, the vaccine (trade name BioTrax) is inoculated in a six-dose regimen for the protection of the Defense Department said Bryan Whimen, Pentagon's spokesman.
The dispute in court began in 2004 when a federal judge stopped the vaccination program because the FDA's review on the vaccine was limited. The program was resumed after the FDA approved it on December 2005.
Anthrax is used as a biological warfare agent and is a bacteria that may cause serious sickness or even death.
