Congress Is New Battleground For Formula Milk Ban In The Philippines

Philippines Senator Pia S. Cayetano on Wednesday said she fully respects the 12-0 decision of the Supreme Court declaring null and void the total advertisement ban on breast milk substitutes under the revised implementing rules and regulations of Executive Order No. 51 or the National Milk Code.

But the lady senator was quick to point out that all is not lost for breastfeeding advocates since an amendment to the Milk Code can always be introduced in Congress with the purpose of strengthening the law's prohibitions on the promotion of infant formula and breast milk substitutes

Filipino Supreme Court Strikes Down Ban On Infant Formula Ads

The Philippine Supreme Court on Tuesday lifted the ban on the advertisement of infant formula milk products. The High Tribunal ruled against implementing provisions in the Milk Code that bans the promotion and advertisement of breast milk substitutes for infants and young children up to 24-months-old.

The court ruled the Department of Health (DOH) overstepped its powers in instituting a ban, and will not enforce the ban unless the Milk Code is changed, by law. Chief Justice Reynato Puno, in a separate concurring opinion, said the absolute ban on advertising is "unduly restrictive" and "more than necessary" for government's interest of promoting the health of infants and young children
